1. Acceptance of Terms
By accessing FreighterDeck (freighterdeck.com), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. These terms may be updated; continued use after updates constitutes acceptance.
2. Nature of the Service
FreighterDeck is a decision-support intelligence product. It provides general freight risk information derived from public sources, official notices, and third-party news. It is not freight brokerage, carrier selection advice, customs brokerage, insurance, legal, financial, investment, or professional logistics advice.
3. No Professional Advice
Nothing on FreighterDeck constitutes freight brokerage, customs brokerage, legal, tax, insurance, or financial advice. FreighterDeck does not guarantee shipment arrival times, freight rates, carrier performance, customs clearance, port availability, or route conditions. Always verify with qualified professionals and primary sources before making operational or financial decisions.
4. Information Accuracy
FreighterDeck aggregates public and third-party information. Data may be incomplete, delayed, inaccurate, revised, or subject to source reporting limitations. Carrier-reported freight statistics may be revised by their sources. We make no warranty as to the accuracy, completeness, or timeliness of any information. Use at your own risk.
5. Subscriptions and Billing
Paid subscriptions are billed monthly or annually via Stripe. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial periods. SapienCX LLC reserves the right to modify pricing with notice.
6. Access Tokens
Paid subscribers receive access tokens. Tokens are for individual or team use only as specified by your plan. Do not share tokens outside your authorized users. SapienCX LLC may revoke tokens for abuse or terms violations.
7. Intellectual Property
FreighterDeck content, design, software, and analysis are the property of SapienCX LLC. You may not reproduce, scrape, resell, or redistribute FreighterDeck content without written permission. Public source data remains the property of its respective owners.
8. Prohibited Use
You may not use FreighterDeck to: (a) resell or redistribute content; (b) scrape or systematically harvest data; (c) compete with FreighterDeck; (d) violate any applicable law or regulation; (e) access accounts you are not authorized to use.
9. Disclaimer of Warranties
FreighterDeck is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or accurate.
10. Limitation of Liability
To the maximum extent permitted by law, SapienCX LLC's total liability for any claim arising from use of FreighterDeck shall not exceed the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold harmless SapienCX LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of FreighterDeck, violation of these terms, or violation of any third-party rights.
12. Governing Law
These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Virginia.
